Terms and Conditions

 

By booking or participating in a Piggy Kitchen tour or any related products or services (a "Tour" or "Service"), operated by Piggy Kitchen LLC. ("Piggy Kitchen", "us", or "we" ), you ("you") agree to these Terms & Conditions (the "Terms").   

We reserve the right to change or modify portions of these Terms at any time.  If we do so, we will post the changes on this page and will indicate at the top of this page the date the revised Terms were effective. 

 

THE BOOKING CONTRACT

By booking a Tour you acknowledge that you have read, understand and agree to be bound by these Terms.  In addition, you warrant that you are 18 years of age or older, that you possess the legal authority to enter into these Terms of Service, book the Services or purchase goods, and that all information you supply is and will be true and accurate.
It is your responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure and travel to France.  This includes a valid passport.  You must have a passport that is valid 6 months after the last date of travel with the us as set out on your itinerary.  You accept full responsibility for obtaining all such documents prior to the start of the Tour, and you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation. 

 

BOOKING ON BEHALF OF OTHERS

By booking on behalf of other participants, you are deemed to be the designated contact person for every participant included on that booking.  This means that you are responsible for making all payments due in connection with your Tour booking, notifying us or your travel agent if any changes or cancellations are required and keeping your party informed.

By booking on behalf of another person or persons, you represent and warrant that you have obtained all required consents.  You are responsible for verifying that any information you provide on behalf of another participant is complete and accurate and we will under no circumstances be liable for any errors or omissions in the information provided to complete a booking.

 

MEDICAL CONDITIONS 

If you make a reservation for a Tour, we will assume that you have no medical conditions, disabilities, general health issues or food or allergy issues (“Medical Conditions”) that would prevent or hamper you from participating in the Tour.  In the event that you do in fact have any Medical Conditions, we will attempt to accommodate them when we can.  In the event that you cannot participate in the Tour because of undisclosed Medical Conditions, we may offer a substitute Service or cancel your reservation without refund.  Please contact us if you are unsure about whether you are able to participate in a Tour. 
Under no circumstances should you travel or attend our Tour if your doctor has advised you against it, or would advise you against it if consulted. 

 

SPECIAL REQUIREMENTS

Any special requirements must be disclosed to us at the time of booking.  We will use reasonable efforts to accommodate special requirements or requests but this is not always possible given the nature of the destinations visited and availability of options outside a planned itinerary.  Certain activities may be inaccessible to you if your mobility is limited in any way.  All food allergies and dietary restrictions must be disclosed to us at the time of booking but we cannot guarantee that dietary needs or restrictions can be accommodated.  Any special requests or requirements do not form part of these Terms or the contract and we are not liable for any failure to accommodate or fulfill such requests.

 

AGE REQUIREMENTS

You must be 18 or older to participate in a Tour.   

 

PRICES, SURCHARGES AND TAXES

The published price of the Tour and any associated products or services offered by Piggy Kitchen is subject to change at any time, before or after booking confirmation, up to 30 days before departure.  Tours are priced and advertised exclusive of applicable sales taxes.  After we receive a confirmation invoice, we reserve the right to impose surcharges on any products or services booked for reasons arising from increases in transportation costs, fuel costs, dues, taxes or associated chargeable fees such airport charges, local operator costs, currency and exchange fluctuations, increases in taxes, or government action which impacts the price of the applicable products or services; provided however, we will only do so where the increase in question is greater than 2% of the original price paid for the products or services (excluding add-ons, insurance, and taxes). Upon learning of the necessity to impose a surcharge in accordance with this section we will provide notice to you as soon as reasonably possible.  Upon such notification, you have two options:

  1. cancel the applicable booking without incurring any penalty; or
  2. accept the change of price.

You must notify us of your choice within 14 days of receipt of notice of the increase or you will be deemed to have accepted the price change and will be liable for payment of the increase.

 

TRAVEL INSURANCE

Tour prices do not include travel insurance.  We recommend you purchase your own policy, or sign a waiver indicating you have opted out.

 

AIRFARE

Tour prices do not include international or other airfare or any transportation to your departing flight unless expressly mentioned in the Tour’s descriptions.

 

CANCELLATIONS BY YOU

You may cancel your booking by notifying us. Cancellation fees, if any, will be determined with reference to the date on which we receive notice of cancellation and are expressed as a percentage of the total price paid for the cancelled tour, product or service.

Payment of 50% of the total cost of the tour is due upon booking. The remaining balance is due by close of business August 1, 2023. 

Cancellation received within 72 hours of deposit:  100% refund. 

Cancellation received after 72 hours - July 1, 2023:  75% refund

Cancellation received July 2, 2023-August 1, 2023:  50% refund.

Cancellations received after close of business August 1, 2023, are fully nonrefundable.

 

CANCELLATIONS BY US

We will make every reasonable effort to provide the Tour in accordance with the descriptions provided on our Site. Although it is unlikely that we will have to make any changes to your reservation or cancel confirmed reservations, we reserve the right to do so. If we cancel your reservation, we will provide you either a credit that you may use towards another Service or a full refund at our discretion.

Please note all Tours require a minimum number of participants

If the minimum number of bookings required for a Tour has not been received, we may cancel the tour. We will notify you of cancellation for this reason no later than close of business June 23, 2023.

Piggy Kitchen Tours will be confirmed as soon as we have 4 confirmed (deposit paid) participants. If we do not have this number of participants by close of business June 23, 2023, we will cancel the Tour and refund your deposit.

In the event of a Tour cancellation, Piggy Kitchen shall not be held liable for reimbursement of your costs associated with the cancelled tour, including airline tickets, transportation, travel insurance, or any associated purchases incurred by you.  We strongly recommend purchasing travel insurance to mitigate potentially non-refundable costs.    

 

TRIP PARTICIPATION AND CODE OF CONDUCT

You agree to accept our authority and decisions or any agent while on the Tour.

You accept responsibility for the proper conduct of yourself and any or all other members of your group.

You must at all times comply with all applicable laws and regulations of all countries and regions. Should you fail to comply with the above or commit any illegal act when on a Tour or, if in our opinion your behavior is causing or is likely to cause danger, distress or material annoyance to others, we may terminate your travel arrangements on any product or service immediately at your expense and without any liability on our part. You will not be entitled to any refund for unused or missed services or costs incurred as a result of termination of your travel arrangements, including, without limitation, return travel, accommodations, meals, and incidentals.

You are responsible for any costs (including repair, replacement and cleaning fees) incurred by us or our suppliers for property damage, destruction or theft caused by you while on a Tour. You agree to immediately report any pre-existing damage to us or associated staff of the accommodation, transportation service, or facility as soon as possible upon discovery.

You agree to take all prudent measures in relation to your own safety while on Tour including, but not limited to, the proper use of safety devices (including seatbelts) and obeying all posted signs and oral or written warnings regarding health and safety. Neither we nor our Third Party Suppliers are liable for loss or damages caused by your failure to comply with safety instructions or warnings.

We reserve the right to terminate your Tour or that of any member of your group whose conduct we or our guides consider disruptive or detrimental to the enjoyment of other guests.  In such event we shall have no further responsibility or liability to you. No refund or payment of any costs incurred by you will be made by us under these circumstances. 

Piggy Kitchen or any associated Third Party are not liable and will not assume responsibility for any claims, losses, damages, costs or expenses arising out of inconvenience, loss of enjoyment, upset, disappointment, distress or frustration whether physical or mental, resulting from the act or omission of any party other than Piggy Kitchen or associated Third Party.

 

SHIPPING OF PURCHASES

This is an antique shopping tour.  We assume no responsibility for or ownership of any purchases you may make in the field.

You agree to have sufficient financial resources and to pay all costs associated with the final disposition of all your purchases in a timely manner.

In making any purchases that require third party shipping to your home, you agree to have sufficient financial resources to pay all fees associated with collection, storage, insurance, transportation, shipping and delivery to you, at our request and in a timely manner.  Failure to do so may result in your forfeiture of those purchases without financial reimbursement.

All product and antique or vintage items purchased are collected, handled, transported, stored, packed, insured, shipped, and accepted by third parties.  In the unlikely event of damage or loss of any items, whether through accident or force majeure, we will work in good faith with our Third Parties to financially resolve any issue.  Piggy Kitchen will not be held legally or financially responsible for any loss or damage as described above.  We recommend you thoroughly document by photo all purchases.

You further agree to accept our authority and decisions, and that of our Third Parties in regards to the timing of all collection, handling, transportation, storage, packing, insuring, shipping, and delivery to you.  

All items purchased by the Tour participants will be shipped together to the U.S. via container by boat.  While we and associated Third Parties will make our best effort to deliver your purchases in a timely manner, we will not be held responsible in any way for any scheduling delays.

 

CHANGES

Changes made by Us: we may modify your itinerary where reasonably required at our sole discretion. If we make a change which materially affects the character of a product or service in its entirety (a "Material Change"), we will provide notice to you as soon as reasonably possible, provided that there is sufficient time to do so before departure. If a Material Change is made more than 14 days before departure, you may choose to:

(a) accept the Material Change and proceed with the amended product or service;
(b) book another product or service of equal or greater value, if available (you will be responsible for paying any difference in price); or
(c) book another product or service of lesser value, if available (with a refund payable to you for the difference in price); or
(d) cancel the amended product or service and receive a full refund for the land-only portion of the applicable product or service (a refund is not available for other products or services booked which are not subject to a Material Change).

You must notify us of your choice within 7 days of receiving notice or you will be deemed to accept the amended itinerary.

Once a Tour has departed, itinerary changes may be necessary as a result of unforeseen circumstances, operational concerns, or concerns for your health, safety, enjoyment or comfort.  Any changes are at our discretion.

You acknowledge that you must have reasonable financial resources to cover incidental expenses during all travel with Us, whether or not such expenses arise from a change of itinerary, and we are not liable for your failure to prepare adequately for travel and unforeseen circumstances which may arise during travel. We will not be liable for any indirect and or consequential losses associated with any changes to a booking or itinerary.

Changes made by you:  Any changes to a booking depend on availability and are subject to our approval and these Terms. Any extra costs incurred for making the change will be charged to you along with an administrative fee. Cancellation of any Tour, product or service included in a booking will not be considered a change for purposes of this section and will be governed by the applicable cancellation terms. No changes are permitted to any booking within 10 days of departure of the first product or service on the applicable booking.

 

LIABILITY

Piggy Kitchen LLC and its directors, successors, representatives, and assigns shall not be held liable for (A) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any other provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider; and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control. You waive any claim against Piggy Kitchen for any such loss, damage, injury, or death.

In the event that any loss, death, injury or illness is caused by the negligent acts or omissions of Piggy Kitchen or of the Third Party Suppliers of any services which form part of the booking contract then we limit our liability, where applicable by all applicable international conventions.

Notwithstanding anything to the contrary elsewhere in these Terms, Piggy Kitchen will not in any circumstances be liable to you for any loss or anticipated loss of profit, loss of enjoyment, loss of revenue, loss of luggage or personal items or valuables of any nature, loss of use, loss of contract or other opportunity nor for any other consequential or indirect loss or damage of a similar nature.

For claims not involving personal injury, death or illness, any liability Piggy Kitchen may incur for the negligent acts or omissions of its suppliers will be limited to a maximum of the price which you paid for the applicable Tour, not including insurance premiums and administration charges.  

If Piggy Kitchen is found liable for any loss or damage that arises out of or is in any way connected with your use of the Site or your booking or use of the Services made available through our Site, then Piggy Kitchen’s liabilities will in no event exceed, in the aggregate, the transaction fees paid to Piggy Kitchen for the transaction(s) on this Site giving rise to the claim.

 

FORCE MAJEURE

Piggy Kitchen will not be liable in any way for death, bodily injury, illness, damage, delay or other loss or detriment to person or property, or financial costs both direct and indirect incurred, or for our failure to commence, perform or complete any duty owed to you if such death, delay, bodily injury (including emotional distress or injury), illness, damage or other loss or detriment to person or property is caused by Act of God, mechanical breakdowns, terrorist activities or threat thereof, civil commotions, labor difficulties, interference by authorities, political disturbance, howsoever and where so ever any of the same may arise or be caused, riot, insurrection and government restraint, fire, extreme weather or any other cause whatsoever beyond our reasonable control; or an event which we or the Third Party Supplier of services, even with all due care, could not foresee any and all of which, individually and collectively, constitute "Force Majeure".

 

PRIVACY POLICY

Piggy Kitchen must collect your personal information to deliver the Tour and any products or services booked. We collect, use and disclose only that information reasonably required to enable us and our Third Party Suppliers to provide the particular Tour, products and/or services that you have requested as described in Piggy Kitchen's Privacy Policy, which can be accessed any time HEREand is expressly incorporated into these Terms. By submitting any personal information to the Tour Operator, you indicate your acceptance of the Tour Operator’s Privacy Policy.

 

SEVERABILITY

If any provision of these Terms is so broad as to be unenforceable, such provision will be interpreted to be only as broad as is enforceable. The invalidity or unenforceability of any provision hereof will in no way affect the validity or enforceability of any other provision.

 

WEBSITE AND ADVERTISING ACCURACY  

All information contained on the Site and in our advertising materials has been provided in good faith, and is considered correct at the time of publication. However, occasional errors may occur, and information may subsequently change, and we are not responsible for such errors or omissions. You must therefore ensure you check all details of your chosen Service (including the price) at the time of booking.  It would also be a good idea to confirm as the date approaches, though you are not required to do so.

  

THIRD PARTY SITES

The Site may contain links to third party websites, services or other resources on the internet (“External Sites”). These links are provided solely as a convenience to you and not as an endorsement by us of the content on such External Sites. We are not responsible for the content of any linked External Sites and do not make any representations regarding the content or accuracy of any materials on such External Sites.  If you decide to access any External Sites, you do so at your own risk. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused in connection with the use of or reliance on any content, goods or services available on or through any External Sites.

 

PHOTOS AND VIDEOS

Piggy Kitchen reserves the right to use photograph/video taken during the Tour or at any event sponsored by Piggy Kitchen without further consent or written permission of those included within the photograph/video. We may use the photograph/video in publications or other media material produced, used or contracted by us including but not limited to:  brochures, invitations, books, newspapers, magazines, television, websites, etc. Individuals will not be identified using full names or personal identifying information without written approval from the photographed subject.  If you do not wish to have your image recorded for distribution, please advise us at info@thepiggykitchen.com prior to your reservation.  By participating in the Tour or events and failing to notify us prior to your reservation or event of your desire to not have your photograph/video used by Piggy Kitchen, you are agreeing to allow us to do so and to release, defend, hold harmless and indemnify Piggy Kitchen from any and all claims involving the use of your picture or likeness.

You may not use any photographs or videos recorded during the Tour for commercial purposes without our written consent.

 

GOVERNING LAW

You agree that: (a) Piggy Kitchen shall be deemed solely based in Chicago, Illinois; and (b) the Site shall be deemed a passive website that does not give rise to personal jurisdiction over Piggy Kitchen, either specific or general, in jurisdictions other than Chicago. These Terms of Service shall be governed by the internal substantive laws of the State of Illinois, without respect to its conflict of laws principles. Furthermore, the parties agree that the sole and exclusive venue for any dispute or claim arising out of or in connection with these Terms of Service shall be the state and federal courts sitting in Chicago, Illinois.
